April 16, 2009 Regular Meeting Agenda Item #5 Item Title C-4 Settlement Agreement with Ricky Burgess and Alicia Burgess as his wife Issue/Rationale The settlement with Mr. and Mrs. Burgess settles their lawsuit against the School Board of Clay County, Florida filed in the Circuit Court seeking money damages for injuries received by Ricky Burgess and the loss of consortium suffered by Alicia Burgess when the vehicle being driven by Ricky Burgess was struck from the rear by a school bus owned by the School Board of Clay County, driven by an employee of the Board, which accident occurred on March 21, 2006, and resulted in injury to Mr. Burgess which necessitated surgery, hospital confinement, incursion of medical bills and continuing disability and permanent injury. Recommended Action Approve the Settlement Agreement which was arrived at through mediation attended by Board member Carol Vallencourt and Attorney Bruce Bickner.
