January 21, 2010 Regular Meeting Agenda Item #4 Item Title C-3 Settlement Agreement with Carol Ann Malicki Issue/Rationale The approval of this item will settle her lawsuit against the School Board of Clay County, Florida filed in the Circuit Court seeking money damages for injuries received on November 30, 2005 when a school bus owned by the School Board of Clay County and driven by a district employee turned into the path of the Malicki vehicle, which action resulted in a crash.  Damage to the Malicki vehicle exceeded $9000.00  Unpaid medical bills exceed $10,000.  Plaintiff continues to have phuysical problems resulting from the accident, which problems have been determined to be permanent in nature. Recommended Action Approve the Settlement Agreement. Financial Impact $15,000.00 Submitted By Bruce Bickner, School Board Attorney
