Agenda Item #51 Item Title D-3 Approve Resolution to place the question of appointment versus election of Superintendent of Schools on the November 2014 election ballot (Mrs. Studdard) Issue/Rationale Article IX Section 5 of the Constitution of the State of Florida provides that in each school district there shall be a superintendent of schools who shall be elected for a term of four years, or, when provided by resolution of the district school board, approved by the vote of the electors, shall be employed by the district school board as provided by law. Florida statute 1001.461 provides that the district school superintendent shall be appointed by the district school board in a district wherein the proposition is affirmed by the majority of the qualified electors voting in the same election making the office of the district school superintendent appointive. To submit the proposition to the electors the district school board by formal resolution shall request an election that shall be at a general election or a statewide primary or a special election, after which the district school board shall make a timely request to the board of county commissioners, which board shall cause to be placed on the ballot at such election the proposition to make the office of district school superintendent appointive. The question of whether or not to have an appointed school superintendent is one that should be presented to the electors. Approval of this Resolution will give the electors the opportunity to consider that question. Recommended Action Superintendent does not recommend approval.
