Title Approval to Advertise and Notice of Public Hearing to Approve The 2020-2021 Clay County District Schools Smart Restart School Reopening Plan | ||
Description On July 6, 2020, The Commissioner of the Florida Department of Education, Richard Corcoran, issued DOE Order No. 2020-EO-06, an Emergency Order the purpose of which was to accomplish the goals of reopening all K-12 schools within the State of Florida, including charter schools, with an offering of full services, suspending reopening requirements as necessary to ensure financial continuity of the educational process, retaining high-quality school choices for Florida students and families and maintaining all services that are legally required for all students. The attached 2020-2021 Clay County District Schools Smart Restart School Reopening Plan, created to accomplish the FDOE goals, was adopted on an emergency basis on July 28, 2020 because there was insufficient time to comply with the full adoption process required by Sec. 120.54, Fla. Statutes. Because it meets the definition of a “Rule” it was required to be approved by the School Board prior to implementation and submission to the FDOE for approval. Florida law provides that a Rule adopted by emergency procedures shall not be effective for more than 90 days during which time the School Board may initiate and complete rulemaking to adopt a rule addressing the subject of the emergency rule if it wishes the rule to extend beyond 90 days. This process requires publication of notice of adoption and a public hearing. | ||

Expected Outcomes Approval of this item will allow the School Board to advertise the proposed adoption and public hearing of the proposed rule which will lead then lead to the consideration of passage of the Rule by the School Board. The Reopening Plan will be advertised, submitted to the public for comment and to the Board for public hearing and consideration in the manner contemplated by the Administrative Procedures Act. | ||

Financial Impact Undetermined at this time. It is believed that the approval of the Plan is essential to qualifying for financial continuity and support from FDOE which will support the school districts multiple programs for the 2020-2021 school year. | ||
