In June of 2022, representatives from DR Horton and Rogers Towers P.A. contacted the Clay County School Board’s Planning department seeking approval to develop a portion of a 248.14 acre tract of land in the Middleburg area of Clay County: Branan Field Park project, 310 single family attached residential lots.

It was determined “inadequate capacity (student stations) at Middleburg High School and contiguous High Schools” specifically, 42 high school students stations.

In accordance with the Clay County Interlocal Agreement for Coordinated Planning (CCIA), to mitigate the deficiency, a PSM agreement may be entered into between the School Board and the developer.  Negotiations between the School Board’s Planning department and DR Horton, Inc. in accordance CCIA’s calculation methodology, resulted in a mutually agreeable resolution. The sum of $2,122,260.00 would be paid to the School Board’s impact fee account to mitigate the capacity deficit.  In return, the School District would ensure sufficient capacity to accommodate the high school students generated by the Branan Field Park project.

No action would result in a School Board Concurrency Reservation denial letter. In effect, The Clay County Board of County Commissioners would deny approval of the Branan Field Park project.

The School Board approved the Ayrshire PUD PSM Agreement in September 2021.

It is expected the School Board will approve the PSM agreement and forward it to the Clay County Board of County Commissioners for their approval.
