Title D1 - Consider rescission of September 26, 2017, School Board action to join the lawsuit challenging the constitutionality of House Bill 7069 (Submitted by Mrs. Condon)
Description Consider rescission of School Board action taken on September 26, 2017 through which the Board: (1) authorized the Superintendent and School Board Attorney to enter into an agreement with other school districts to collectively pursue legal action challenging the constitutionality of House Bill 7069, and (2) allocated up to $25,000 for legal expenses associated with such legal action. The School Board first considered joining a collective legal action challenging the constitutionality of HB 7069 at its August 3, 2017 regular meeting. Having subsequently received additional information as to the status and developments of the then-anticipated lawsuit to be brought by numerous other school boards/districts, a majority of the School Board membership voted (3-2) to join the collective action at its regular meeting on September 26, 2017. At the conclusion of the School Board’s regular meeting on January 4, 2018, Board Member and Vice Chair Elizabeth Condon expressed her intention to add to the February 1, 2018 meeting agenda the foregoing item.
