Title C10 - Charter School Contract Renewal:Florida Cyber Charter Academy (FLCCA) | ||
Description Section 1002.33(8)(a), Florida Statute, requires the district to "make student academic achievement for all students the most important fact when determining whether to renew or terminate a charter." The Charter with Florida Cyber Charter Academy at Clay, which opened 2014-2015 will expire on June 30, 2024. The school currently serves approximately 250 K-12 students. Northeast Florida virtual Charter Board, Inc. has requested that its charter be renewed for a term of 5 years. This is a virtual charter that is one of three virtual school offerings that can be accessed through the district, in addition to CVA and FLVS. As a result of open enrollment, the school is able to accept students from across the state. Currently 37 of the enrolled students life in Clay County. Per Section 1002.33(7)(c)1, FS, a charter may be renewed provided that the program review demonstrates that statutory requirements have been met and none of the grounds for non-renewal listed in statute have been expressly found. The grounds for non-renewal listed in statute are as follows:
A charter school that meets these requirements and has received a school grade lower than a "B" in the most recently graded school year must be renewed for no less than a 5-year term provided the school has not earned two consecutive grades of "F", per statute. Evidence of Compliance to the above items:
Percent Tested: School Grades 2. As required, the school submits Monthly financial Statements to the district in a timely manner on templates provided by the district. An annual audit is also provided each of which demonstrates financial stability. Renewal Process The Charter School Contract Renewal Review is part of a formal process followed by the Clay County District Schools' School Choice Office to thoroughly and systematically review the charter school seeking renewal. The renewal review covers the educational program practices, organizational practices and business practices evident at the school site and relevant to Charter School Law and the contract between the Clay County School Board and the Charter School Board. The Renewal Team, composed of School Choice staff, District employees from Human Resources, Curriculum/Instruction, Assessment, Business/Finance, Operations, ITS, and Federal Programs, participate in a site visit and the renewal process. A full report of the criteria reviewed and an associated rating scale of Yes (meets compliance), P (partial compliance, and N (does NOT meet compliance) is made available for review. | ||

Previous Outcomes The School Board of Clay County approved the school's initial application in 2014 and its first 5-year renewal in 2019. | ||
Expected Outcomes Approval to renew. The school has a past performance level of at least a C, they meet accepted standards of fiscal management, and adhere to applicable laws. The contract/charter will be negotiated over the next three months prior to the June 30 expiration of the current contract/charter. | ||

Financial Impact For the 2022-23 school year, $1,485,00.37 was passed through to the school through FEFP and State and Federal Grants with 5% withheld by the district for applicable administrative fees at $48,257.80. Section 1002.33(17)(b), F.S., sets forth the funding formula whereby school districts pass through state funds to charter schools, and Section 1002.33(20)(a), F.S. sets forth the school district's ability to retain up to 5% for enrollment of up to and including 250 students of the student funding for the school district's administrative fees for providing certain central services. As a virtual school, tax dollars assigned for capital improvements are not passed through. | ||
