Section 1002.33(8)(a), Florida Statutes, requires the district to “make student academic achievement for all students the most important factor when determining whether to renew or terminate the charter.”

The Charter with Florida Cyber Charter Academy at Clay, which opened as a K-8 virtual school in the 2014-15 school year with a five-year contract, will expire on June 30, 2019. The school added a grade level each year and currently hosts kindergarten through twelfth grades. Currently in its fifth year of operation, the School serves 90 students in grades kindergarten through twelfth grade, which is within the enrollment cap of 91 stated in the existing contract.

Florida Cyber Charter Academy at Clay has requested that its Charter be renewed. The School is managed by K12.

Fulfillment of Provisions of 2014-19 Five-Year Contract Florida Cyber Charter Academy at  Clay’s mission is to “provide a high-quality, online public charter school, that will build a community of students, families, educators and a governing board dedicated to providing a high-quality learning environment that will be accountable for developing each student's full potential by utilizing research-based technology applications, meaningful teacher/student/parent involvement, and engaging, individualized learning. We will produce exemplary levels of student achievement, equipping all students with the academic and nonacademic foundations needed for any post-secondary opportunity they wish to pursue.”

The school opened in 2014 and its office is located at 9143 Phillips Highway, Suite 590, Jacksonville, Florida 32256. The location in Jacksonville is also the central office for the following charter schools: Florida Cyber Charter Academy at Duval and Florida Cyber Charter Academy at Osceola. Florida Cyber Charter Academy at Clay met the targeted School Performance Grade designation of a C or better during the last two of the past four years of the current contract term:

 

  • Year 1 (2014-15) I-incomplete due to inadequate number of students being tested to qualify for a grade

  • Year 2 (2015-16)  I-incomplete due to inadequate number of students being tested to qualify for a grade

  • Year 3 (2016-17) C

  • Year 4 (2017-18) C

Though the school has not received accreditation, it is currently undergoing the accreditation process through AdvancED. The school’s attorney and leadership team have communicated that the school will be recommended for full accreditation.  This is expected to happen in spring of 2019.

As required, the school submitted Monthly Financial Statements to the sponsor in a timely manner. The school has demonstrated financial stability during the five-year contractual period.

A site visit that included an instructional review was conducted on May 17, 2018. The school was in compliance as per contract and statute.

Recommendation

1.  That Clay County School Board approve the Charter School's request to renew its contract with the Clay County School Board.

2. The Clay County School Board approve a charter renewal contract in a form substantially similar to that which is attached.

Financial Impact
2017/2018 fiscal year, $302,084.80 with approximately FTE of 60 of the State's funds were passed through the District and paid to Florida Cyber Charter Academy at Clay . This will increase with increased enrollment in 2019-20. If they were to have an FTE of 115 it would be approximately $571,377.50. Section 1002.33(17)(b), FS, sets forth the funding formula whereby school districts pass through state funds to charter schools, and Section 1002.33(20)(a), F.S., sets forth the school districts' ability to retain up to 5% for enrollment of up to and including 250 students of the state funding for the school districts' administrative fees for providing certain central services. The District's annual pass-through of funds depends on student enrollment each year.
