Description

A state of emergency exists in the form of a COVID-19 pandemic. The district, in accord with the recommendations of the Governor, is opening its facilities and grounds to use by students, parents, and numerous religious, athletic, social, civic, child care, academic, and other gatherings at which citizens will congregate. Daily sanitizing will be necessary, and expensive. Limitation of liability for exposure to COVID-19 will be necessary. In the present posture, School Board policy as to facilities and grounds use does not adequately address this situation and therefore creates an immediate danger to the public health, safety and welfare of students, employees and the general public. The normal process of adoption of policy to meet the threat is too slow to meet the threat. Declaration of an emergency and passage of an emergency policy to meet the threat while policy is being passed through normal channels is needed.

Gap Analysis

The School Board by finding that an immediate danger to the public health, safety and welfare exists which requires adoption of policy on an emergency basis, may then approve board policy which will protect the public interest until the policy can go through the full adoption process required by Sec. 120.54 Fla. Statutes. The emergency policy, in this case the process, whichever is earlier.  Use of Facilities & Grounds Manual, is valid for a maximum of 90 days or until it is adopted by the full
