C23 - Approve the Restated Concurrency Proportionate Share Mitigation (PSM) Development Agreement for Governor’s Park: Development of Regional Impact (DRI).
Description

In May of 2009 the Clay County School Board approved a PSM for Governor’s Park DRI, recorded with the Clay County Clerk of Court INST# 2009033288 (Exhibit A). On December 12th 2017, the Clay County Board of County Commissioners (BCC) enacted Ordinance 2017-45; which amended the Governors Park DRI General Conditions to change the phasing of the DRI.   On February 12th 2019 a group representing the developer and potential new owners of Governor’s Park met with CCSB Operations Staff with a Restated PSM (Exhibit B) encompassing the BCC’s phase change amendment.  The Restated PSM delineated non-substantive changes.  CCSB Operations Staff reviewed the document, requested location of one school site be moved and forwarded the document to the CCSB Attorney for review. The CCSB attorney, returned the Restated PSM with the following comment “I am of the opinion that the…Agreement is, from a legal standpoint, correct and is ready for approval by the Board”.

Gap Analysis

No action would result in significant delay to the necessary conditions required for closing proceedings of the acquisition.  The Item had been approved by the Clay County Planning commission during their April 2nd meeting.

Previous Outcomes

The Board approved the previous Governor’s Park PSM Agreement: May 2009.

Expected Outcomes

It is expected that the School Board will approve the Restated Governor’s Park PSM agreement.

Approve the restated previously approved Governors Park Restated PSM Agreement.
