M.N., by and through his parent and guardian, D.N., filed a lawsuit against the School Board of Clay County, the School District of Clay County, and a former School District teacher alleging violations of M.N.’s constitutional and civil rights. M.N. has alleged that he was physically abused and had food withheld from him by the former teacher while a student in that teacher’s ESE class at Fleming Island Elementary during the 2011-2012 school year. M.N. claims to have suffered emotional harm because of the alleged abuse that required extensive therapeutic treatment. M.N.’s counsel made a pre-suit demands of $500,000.00 from the School Board and School District relative to this claim and $300,000.00 from the former teacher relative to this claim. The parties have agreed to settlement with the District paying $50,000 and the teacher’s insurance provider contributing $30,000.
