Title C18 - Approve school concurrency Proportionate Share Mitigation Agreement with the Reinhold Corporation/Peters Creek Investments LLP, a Jacksonville, Florida limited liability partnership (Saratoga Springs Project) | ||
Description Pursuant to the Clay County Board of County Commissioners (BCC) resolution 06/07-12, a Development of Regional Impact (DRI) order/agreement was entered into between the BCC, the School board of Clay County, Florida (SBCC) and Peters Creek Investments, LLC. This DRI for 4,256 dwelling units obligated the developer, pursuant to a land trade agreement between the developer and SBCC, to, among other requirements, deed seventy-seven (77) acres of suitable land for construction of schools within the boundaries of the DRI. The deeded land would be free of, and not subject to, the imposition of educational impact fee credits. The current developer desires to abandon the original DRI and to enter into a new development Order Agreement with the BCC and the SBCC. The new instrument would allow the increase of the number of dwelling units by 744 to a total of 5000. | ||
Gap Analysis Failure to approve the PSM by the SBCC would result in the issuance of a School Board Concurrency Reservation denial letter. In effect, Clay County BCC could deny the approval of the abandonment of the current/original DRI and approval of the new Development Order. | ||
Previous Outcomes The School Board has approved PSM Agreements in the past, including the Avonlea Hills PSM Agreement in November 2020 | ||
Expected Outcomes Approval of this item will result in the Administration forwarding the Agreement to the Clay County BCC for their approval. | ||
