Title D2 - Authorization to Join Statewide Litigation Regarding HB 7069 (Mrs. Kerekes)
Description This item authorizes the Superintendent and School Board Attorney to enter into an agreement with other school districts throughout the State of Florida to challenge the constitutionality of HB 7069. At the August 3rd Regular School Board Meeting, the Board first discussed this topic and requested the School Board Attorney provide regular updates regarding the development of possible litigation. The School Board Attorney has outlined recent developments and his proposal in a memo to the Clay County School Board. The Members of the Clay County School Board must now decide if they wish to join the statewide effort to challenge HB 7069. School districts across the state, through their General Counsels, are working together to bring forth a legal challenge to HB 7069. This proposal will allow our Superintendent and School Board Attorney to engage stakeholders moving forward. This proposal does not authorize a set amount for any financial contribution; the contribution amount is to be set by the School Board, through counsel with the School Board Attorney, should a majority of the Board wish to proceed with joining any potential litigation.
