October 10, 2012 Special Meeting Agenda Item #2 Item Title Settlement of Civil Rights Claim of Patrick Capriola Issue/Rationale Patrick Capriola filed a lawsuit against the School Board of Clay County and Linda Turner alleging violations of his civil rights by the imposition of religious beliefs and political ideology on him by his supervisor.  Additionally, he pled violation of his rights by retaliation against him for his stand on the rights of ESE students and for bringing his civil rights claim.  All alleged violations have been cured.  At mediation Plaintiff's attorneys made a claim for attorney's fees in excess of $75,000.00.  Any damages claimed by Capriola were disputed and unproved.  The parties agreed to settle all claims against both Turner and the School Board for a total of $75,000.00 with no admission of guilt.  Mediation was attended by Carol Studdard, Toni McCabe, Linda Turner, Attorney Tim Strong, Attorney Bruce Bickner, Attorney Michael Grogan and adjuster David Standish, all on behalf of the Defendants.
