Title
Adopt and Approve the Emergency Adoption/Implementation of Clay County District Schools School Safety Policies: 9.17 School Safety Requirements and Monitoring, 9.18 Threat Assessment Policy, and the District's Security and Response to Active Assailant Policy (CONFIDENTIAL).
Description

Effective July 2, 2024, the State Board of Education (SBOE) approved amendments to existing Florida Administrative Code (F.A.C) Rule 6A-1.0018 and 6A-1.0019 , School Safety Requirements and Monitoring, and Threat Management respectively. The effect of the amendment is to update the threat management manual, instrument, and training requirements. Rule 6A-1.0018(4)(b) specifically requires districts to submit updated “...policies and procedures pertaining to the health, safety or welfare of students to the Office of Safe Schools by September 1 of each year”.

There is insufficient time to comply with the full policy adoption process as required by Sec. 120.54, Fla. Statutes. Failure to comply with the rule could result in loss of funding to the District; such a loss is a threat to and therefore creates an immediate danger to the public health, safety and welfare of students, employees and the general public. Therefore, the passage of an emergency amended policy is needed while the final policy is being passed through normal channels taking no longer than 90 days.

Gap Analysis

These revisions to policies are necessary to align Clay County District Schools’ policies with State Board of Education amendments to Florida Administrative Code Rules 6A-1.0018 and 6A-1.0019.

Expected Outcomes

Approval of this item will allow the School Board and the Superintendent to comply with the FDOE Office of Safe Schools and allow the district to move forward with School Safety Requirements while still qualifying for financial continuity which will support the school district's multiple safety initiatives.

In the meantime, the revised policies: 9.17 School Safety Requirements and Monitoring, 9.18 Threat Assessment Policy, and the District's Security and Response to Active Assailant Policy (CONFIDENTIAL) will be advertised, submitted to the public for comment and to the Board for public hearing and consideration in the manner contemplated by the Administrative Procedures Act.
