C14 - Concurrency Proportionate Share Mitigation (PSM) Development Agreement for Reinhold Corporation (Reinhold North Development in the Lake Asbury area)
Description

In December 2018, the Clay County Concurrency Office requested a School Concurrency Reservation Certificate (CRC) letter from the School Board of Clay County’s Planning department to approve The Reinhold North (Reinhold) residential development.  A non-concur letter was issued citing inadequate capacity (student stations) at Shadowlawn Elementary School. Specifically, a deficit of 36 student stations must be mitigated in order to secure a “concur” CRC letter from the School Board’s Planning department.  In accordance with the Clay County Interlocal Agreement for Coordinated Planning (CCIA) a Proportionate Share Mitigation (PSM) agreement may be entered into between the School Board and the developer.  Negotiations between the School Board’s Planning and Legal departments and The Reinhold Corporation, in accordance with CCIA’s calculation methodology, resulted in a mutually agreeable resolution. Pursuant to the proposed PSM, the sum of $877,788.00 will be paid by Reinhold to the School Board’s impact fee account to mitigate the capacity deficit.  In return, the School Board will ensure sufficient capacity to accommodate the elementary students generated by the Reinhold North Development.

 

Gap Analysis

Taking no action would result in denial of the required Clay County School Board Concurrency Reservation Letter. In effect, Clay County would deny approval of the Reinhold North residential development.

 

Previous Outcomes

The School Board recently approved the Governor’s Park PSM Restate Agreement: May 2019

Expected Outcomes

It is expected the School Board will approve the Reinhold Corporation PSM agreement.
