C29 - School Concurrency Proportionate Share Mitigation (PSM) Development Agreement for Bradley Creek Holdings LLC. (Creekview Trail Development in the Lake Asbury area).
Description

In February 2020, the Clay County Concurrency Office requested a School Concurrency Reservation Certificate (SCRC) letter from the Clay County School Board’s Planning department to approve The Creekview Trail development.  A non-concur letter was issued citing inadequate capacity (student stations) at Lake Asbury and Rideout Elementary Schools. Specifically, 264 student stations must be mitigated in order to secure a “concur” SCRC letter from the School Board’s Planning department.  In accordance with the Clay County Interlocal Agreement for Coordinated Planning (CCIA) to remedy the issue, a Proportionate Share Mitigation (PSM) agreement may be entered into between the School Board and the developer.  Negotiations between the School Board’s Planning department and Bradley Creek Holdings LLC, in accordance CCIA’s calculation methodology, resulted in a mutually agreeable resolution. The sum of $6,439,788.68 would be paid to the School Board’s impact fee account to mitigate the capacity deficit.  In return, the School Board would ensure sufficient capacity to accommodate the elementary students generated by the Creekview Trail Development.

Gap Analysis

No action would uphold the School Board Concurrency Reservation denial letter. In effect, Clay County would deny approval of the Creekview Trail residential development.

Previous Outcomes

The School Board recently approved the Reinhold North PSM Agreement:  December 2019

 

Expected Outcomes

It is expected the School Board will approve the Bradley Creek Holdings LLC. PSM agreement.
